School selection is a legal custody issue which requires agreement of both parties, and in the absence of both parties’ agreement a Court Order. In particular, this can become an issue when the parties share physical custody of their child(ren) and live in different school districts, because the child(ren) are permitted to be enrolled in either school district. This issue may also apply when child(ren) are enrolled in public school, and private school is believed to be a better choice, or if the child(ren) are currently enrolled in private school, and public school is better able to meet their needs.
If this is the only issue pending before the Court in your case the Court will use a best interest analysis to determine which school is best for your child(ren). Simply being the school in which your child was previously enrolled is not controlling. The Court will look at both schools to determine which is the best educational fit for your child, which includes looking at a variety of factors in the schools, and your child(ren)’s educational profile to determine the best fit. An analysis of your child’s educational profile may include an analysis of their special needs, learning styles, and the programming offered by the school.
